  1. Scope
    The following terms and conditions apply to all products and services sold exclusively through the Yaksha e-commerce website, yaksha.ch. They define the rights and obligations of both parties. Yaksha reserves the right to modify these terms and conditions at any time.
  2. Offer
    The offer is available to individuals or entities with a residence or headquarters in Switzerland. Products are only delivered to addresses within Switzerland. The offer remains valid as long as it appears on the online store, subject to stock availability. Price and assortment changes may occur at any time.
  3. Products
    The products visible on yaksha.ch and the real-time stock status are for informational purposes only and do not constitute offers from Yaksha. Yaksha reserves the right to limit delivery quantities for certain products and may not fulfil orders that are particularly heavy or bulky.
  4. Personal Data
    Yaksha is committed to protecting the confidentiality of personal data provided by customers on yaksha.ch and handling it according to legal requirements. Personal data is only shared with third parties if necessary for order fulfilment. No data will be shared for commercial purposes. Customer data may be used by Yaksha's internal services:

    To process orders, deliveries, and invoices
    To seek feedback to improve our products and services Customers must provide accurate, valid, and up-to-date personal information for order management. Information related to identification and passwords must be kept confidential by the customer.

  1. Sales Process
5.1 Orders
Once the desired product is selected, it is placed in the "shopping cart" by clicking the "add to cart" button. The customer can continue selecting items, modify their cart, or proceed to checkout and payment. Confirmation of the order by the customer signifies acceptance of the terms and conditions. An order is considered a request to conclude a contract with yaksha.ch. Upon validation and payment of the order, the customer receives an order confirmation via email.

5.2. Prices

Prices listed on yaksha.ch are inclusive of taxes and exclude preparation or logistical shipping costs. Shipping costs will be indicated before final order confirmation. Yaksha reserves the right to change prices and other charges on yaksha.ch without notice. However, products will be billed based on the rates in effect at the time of order confirmation.

5.3. Product Representation

Yaksha strives to ensure that the photographic representation of products and services on yaksha.ch is as accurate as possible. However, due to the nature of online presentation, the customer's perception of the product image may not exactly match the actual product.

5.4. Secure Payments

Accepted payment methods are:
Visa, Mastercard, PAypal
Payments are processed on secure banking or postal servers provided by Yaksha's partners. This means no banking or postal information is transmitted via yaksha.ch. Card payments are securely processed. Orders will be registered and confirmed once the payment is accepted by the chosen payment system. Customers must complete the registration form on yaksha.ch before validating an order. Credit or Postcard details are encrypted using SSL (Secure Socket Layer) and are never transmitted in clear over the network. Payment is directly handled by payment service providers, and the card number is not sent to Yaksha. Orders are considered effective upon confirmation from payment centres.

5.5. Delivery

Shipping costs are calculated based on weight, volume, and the carrier's rates. Costs are borne by the customer if the total order amount is less than CHF 70, with a charge of CHF 7.50. Yaksha ensures the dispatch of goods sold through yaksha.ch to the delivery address provided by the customer during the order process. Delivery times, given as an estimate, are: 4 to 10 working days for Europe In case of temporary stock shortages, Yaksha commits to delivering the missing item as soon as possible or offering a replacement solution.

5.6. Returns, Cancellation, and Refunds

Upon receipt of the product, the customer has a right of withdrawal, which means a 14-day period to return the delivered product at their own expense. Only products purchased through yaksha.ch and returned in their original packaging will be eligible for a refund. The procedure is as follows:

The customer sends an email to hello@yaksha.ch to request a return.
The customer returns the merchandise at their own expense to the address provided by Yaksha. The product must be accompanied by:
The order number
The name of the person returning the order

The product will be inspected by Yaksha’s internal services, which will decide on the refund based on whether the product is returned complete and in a resalable condition, as required by the right of withdrawal. If the merchandise meets the return requirements, it may be refunded or exchanged. If the merchandise does not meet the return criteria, it will be returned to the customer, who will not be entitled to a refund.

  1. Governing Law
    Swiss substantive law applies to the legal relationship between yaksha.ch and the customer, excluding conflict of law provisions and the Vienna Convention. The legal venue for individuals is Vevey or the customer's place of residence.
